Heard counsel for the applicant - accused. Perused record. Perused earlier orders, which show that, this Court was required to ultimately issue non-bailable warrant when the efforts for serving bailable warrant did not succeed. Counsel for applicant is seeking bail again. Being old matter, I have asked the counsel to argue, but he says, he has to seek instructions. The application filed contains arguments on merits of the appeal, but counsel does not agree to argue, though this Court is ready to hear the appeal forthwith. Counsel says that, he will argue the appeal in next week. As such, keep the appeal on 9th August 2016, High on Board, when the appeal should be argued.

There is no justification to again release the accused on bail when earlier the accused became unavailable when bailable warrants were issued. Order dated 15.6.2016 shows, he was no more residing on address concerned. His earlier counsel was also not able to contact him. Criminal Application No.4262/2016 is rejected.
