The learned advocate for the petitioner submits that all along the Education Officer was refusing to even receive the proposal sent by respondent No.3/Management seeking approval to the compassionate appointment of the petitioner. He has learnt from the petitioner today that the Education Officer (Shri Madhukar Deshmukh) has agreed to receive the proposal. He has further agreed to take a decision on the proposal, within four weeks.

We would appreciate if the learned AGP conveys to

*2* 84wp9148o22 all the Education Officers that they cannot refuse to receive the proposals or correspondence from the Institutions or individuals. They may take a decision on such proposals on the merits of the proposals.

As such, this Writ Petition is disposed off at the request of the petitioner.

The Education Officer would take a decision on the said proposal of the petitioner in the light of the judgment delivered by this Court in Yogita Shivsing Nikam vs. State of Maharashtra and others, 2022 (2) Mh.L.J. 370, on or before 15.10.2022.
