Heard the respective learned counsels for the parties. 2.

In similarly situated applications, the Court allowed the applications for withdrawal of amount. Hence, the following order :

ORDER

(i) Civil Application for withdrawal of amount is partly allowed.

(ii) The applicant is permitted to withdraw 50% of the compensation amount deposited by the Acquiring Body subject on usual undertaking to the satisfaction of the Registrar (Judicial) of this Court.

11-CA.10002-23.odt (iii) Further he is allowed to withdraw 25% of the deposited amount on furnishing solvent surety, to the satisfaction of the Registrar (Judicial) of this Court.

(iv) The balance amount be deposited in fixed deposit as per the rules.

(v) Stand over to 13.03.2024.
