Report has been received that appellant No.4 is dead. Photo copy of his death certificate has been provided by the Jail authorities and it is stated that he was released on Corona parole on 11.12.2020 and he expired on 05.11.2021. Under the said circumstance, the appeal as well as application stands abated against him.

In view of the discharge of the Advocate earlier representing the appellants by order dated 12.10.2023 notice was issued to other appellants. Appellant No.1 has given letter that he would engage Advocate of his choice,

Cri.Appln_2165_2018 however, appellant No.3 has given a letter that he needs legal aid. Advocate Mr. Govind A. Kulkarni is appointed to represent appellant No.3. Office to provide paper book to Advocate appointed. Advocate appointed may contact appellant No.3 through video conferencing to be made available by the High Court Legal Services Sub-Committee, Aurangabad, as per convenience of the learned Advocate appointed.

It is also reported that appellant No.2 Bhavdya @ Bhausaheb Gorakh Pawar was released on Corona parole on 11.01.2021, however, he has absconded and offence under Section 224 of the Indian Penal Code has been registered against him with Bidkin Police Station on 01.04.2022. APP to get further details of the said case.

As regards present matter is concerned, issue non bailable warrant against appellant No.2.

Stand over to 13.12.2023.
