O R D E R

1] Mr.D.U.Manwatkar, learned counsel for the appellants, Mr.B.V.Virdhe, learned AGP for the State, Mr.B.R.Surwase, learned counsel for the acquiring body and Mr.P.B.Jadhav, Executive Engineer, Jalna Irrigation Division, Jalna are present. They submit that this matter has been settled amicably between the parties and they have placed on record terms of settlement. The terms of compromise / compromise pursis is taken on record and marked as 'X' for identification. 2] In view of the compromise arrived between the parties and in terms of the compromise pursis, this appeal stands disposed of. It is full and final settlement arrived between the parties. 3] The acquiring body shall deposit the settlement amount as agreed within 8 months from today in this Court. In case of failure on the part of the acquiring body, the appellants - claimants are entitled to get statutory benefits i.e. interest under Section 28 of the Land Acquisition Act, 1894.

2 2035.21FA.odt 4] The claimants are entitled to withdraw the amount of settlement deposited by the acquiring body along with accrued interest, if any.

5] The Court fees refund certificate be issued as per the Rules in favour of the appellant. Registry to take necessary steps to that effect. 6] The award / decree be drawn up in terms of compromise. 7] Civil Application, if any, also stands disposed of. 8] No order as to the costs.
