The applicant seeks grant of anticipatory bail as he apprehends arrest in C.R. No.29 of 2016, registered at Thalner police station, Dist. Dhule, for offences punishable under sections 420, 465, 468, 417 read with section 34 of the Indian Penal Code.

According to the applicant, he is serving as Head Master at the school run by a public trust in which there are certain disputes between the

criap4271.16 (2) two groups of the management. Perusal of the private complaint indicates that it has been stated in paragraph 13 thereof that the present applicant had supported the other trustees in their illegal acts. The incidents of which complaint has been made pertain to the year 2003 onwards. 4.

The application is opposed by the learned Addl. Public Prosecutor on the ground that there is prima facie involvement of the applicant. 5.

Having perused the private complaint and considering the fact that the applicant is Head Master of the school run by the public trust in which disputes are pending, I am inclined to grant relief to the applicant. 6.

In view thereof, the order dated 3rd August, 2016, passed by this Court granting ad interim relief stands confirmed on the same terms and conditions.

The observations made in this order are only for the purposes of considering the prayer made under section 438 of the Code of Criminal Procedure. Same shall not influence the trial. Application is allowed on above terms.
