In the identification parade, present applicant was not identified. Apart from above, this Court must take note of the fact that in F.I.R. there is mention about four accused who have committed the offence but from that angle, the matter is not investigated. 3.

The applicant is in jail since 22/06/2015.

From the perusal of the investigation papers, it appears

4294.15crpln -2that the role attributed to the present applicant is already investigated in the matter. No fruitful purpose will be served by keeping the applicant behind the bar. Hence, I pass the following order. The applicant be released on bail, on furnishing P.R.bond of Rs. 10,000/- (Rs. Ten thousand) with one surety in the like amount, in connection with Crime No. 05 of 2015 registered with Gandhi Chowk Police Station, Latur, District Latur for the offence punishable under Sections 394, 395 read with Section 34 of the Indian Penal Code.

The applicant shall not enter the jurisdiction of the concerned police station and shall every fortnight report to the Police Station, Shivajinagar, Pune District.
