The learned counsel Mr. R. D. Borde holding for Mr. Uday S. Malte, learned counsel for the appellant/insurance company along Mr. Dhammanand Sonone, representative of the Appellant/ Insurance Co. and learned counsel Mr. Atul M. Pawar holding for Shri B. S. Deshmukh, learned counsel for the respondent No. 1 in all matters are present today.

First Appeal No. 2936 of 2008 is not on board. On mentioning of the learned counsel for the appellant, the same is taken on board for disposal.

The learned counsel for the appellant tenders written instructions. The same is taken on record and marked 'X' for identification. He seeks permission to withdraw the appeals. The appeals shall stand disposed of as withdrawn. 4.
The appellant has already deposited 50% of the awarded amount in this Court and further agrees to deposit the balance amount within a period of eight (08) weeks before the M. A. C. T. Jalgaon. The respondent No. 1/claimant shall be at liberty to withdraw the amount which is already deposited in this Court, if not withdrawn. On depositing the balance amount before M. A. C. T. Jalgaon, the respondent No. 1 shall be at liberty to withdraw the same..
