None for the Respondent though duly served. This indicates that Respondent has no inclination to oppose the application.

Applicant is a wife. She seeks transfer of transfer of proceeding No. A-201/2014 from Family Court, Mumbai to Family Court Parbhani.

Learned counsel for the Applicant submits that applicant has no source of income and she has responsibility of a minor child. He further submits that Applicant has filed two proceedings i.e. HMP
- 2 - mca228.24.odt E-102/2023 before Family Court, Parbhani and PWDVA No. 117/2023 before Judicial Magistrate First Class, Parbhani. He submits that prejudice will cause to her defence if she is called upon to attend the proceeding at Mumbai. It is his further submission that in any case Respondent/husband will have to attend these two proceedings filed by Applicant at Parbhani. As such, no prejudice will cause to him if the proceeding pending at Mumbai is transferred at Parbhani.

In view of above uncontroverted facts, application is allowed in terms of prayer clause B.

In order to ensure that the Respondent/husband is not harassed by calling upon him to attend the proceedings on different dates, all the proceedings be heard on the same day. It is the responsibility of the Applicant/wife to ensure the same. ( R. M. JOSHI) Judge dyb
