Learned Counsel appearing on behalf of the respondent, upon instructions, makes a categorical statement that the respondent-husband shall bear transportation and out of pocket expenses of the applicant for attending the court proceedings. He undertakes to deposit Rs.10,000/- within two weeks from today before the Court below at Aurangabad, of which the applicant-wife will be entitled to withdraw Rs.5,000/- on each date, provided she personally attends the proceedings.

The respondent shall continue to deposit amount of Rs.5,000/- on consecutive dates before the Court below.

A single default in deposit of the amount as aforesaid shall result in giving cause to the applicant for moving an application for transfer afresh. 4.

Of the deposit made by the respondent if any amount remains balance with the Court below, the same shall be paid to the applicant and be adjusted in the amount of maintenance, if any, to be paid to her. 5.

With above observations, Misc. Civil Application stands disposed of.
