Both the learned Advocates jointly submit that Complaint (ULP) No.23/2013 instituted by the Respondent, has been withdrawn from the Industrial Court as the complaint instituted by the Respondent before the Labour Court is pending adjudication. A copy of the compromise arrived at in the Lok-Nyayalaya held on 12.04.2014 (three pages) is placed on record, which is marked as Exhibit X for identification.

Shri Golewar, learned Advocate for the Petitioner, therefore,

*2* 903.wp.10243.14 submits that this petition could be disposed of in the light of Exhibit X with liberty to the Petitioner to oppose the complaint preferred by the Respondent before the Labour Court on it's own merits. Shri Patil, learned Advocate for the Respondent, has no objection.

In the light of the above and in view of Exhibit X, this Writ Petition is disposed of as being infructuous. Needless to state, all the contentions of the litigating sides before the Labour Court are kept open and the disposal of this petition shall not be an obstacle to any of their contentions.
