DATED : 12 th AUGUST, 2015 PER COURT :- 1] Heard Shri Yuvraj Kakade, advocate holding for Shri R.S.Chatorikar, learned counsel for applicant. 2] This is an application for anticipatory bail, since the applicant is apprehending his arrest in Crime No. 58 of 2015, registered with Supa police station, District Ahmednagar, for the offences punishable under Sections 392, 342, 506 r/w 34 of the Indian Penal Code.
3] The learned counsel for the applicant submitted that the applicant has a good case for ad-interim anticipatory bail and he insisted for granting the said relief. According to the submission of the learned counsel for the applicant, the first information report is lodged by the first informant against unknown persons. He submitted that the applicant is a reputed person and he is falsely implicated in the crime. Therefore, he submitted that the application for anticipatory bail be considered favourably.
4] The applicant himself has filed on record the remand yadi, dated 9.7.2015. The said remand yadi specifically
crap4305.15 discloses that eight tone iron rods which were robbed in a Highway robbery were found in the house of the present applicant.
5] The offence is serious and when the stolen property is found and is seized from the house of the present applicant, no case is made out for any relief.
6] Hence, the application is dismissed.
