ORAL ORDER :

Heard learned counsel for the petitioner. A simple notice was issued to the respondent returnable on 4th October 2018. Mr. K.D. Khade, learned counsel submits that he has instructions to appear on behalf of the respondent and he will file the Vakalatnama during the course of the day. Learned counsel also invited our attention to the reply filed on behalf of the respondent No.1 Principal, Maharashtra Institute of Technology. The Division Bench of this Court, vide order dated 13.4.2018, directed the respondent to consider that the validity certificate is received by the petitioner and then the respondents were directed not to withhold the market sheet, degree certificate and

Contempt Petition No.595/2018 (( 2 )) other documents of the petitioner considering that the validity certificate is received by the petitioner. The grievance was that, in spite of the order passed by this Court, the documents are not handed over to the petitioner.

Learned counsel appearing for the respondent invited our attention to the undertaking given by the petitioner, which is at Exhibit R-1 of the afÏdavit-in-reply filed by the respondent. The petitioner, by way of this undertaking, submitted that, he has received all the documents from the College and no grievance survives against the respondent. Considering the afÏdavit-inreply and more particularly the statement in the undertaking by the petitioner, nothing survives in the petition as order of this Court is complied with. Contempt Petition is accordingly disposed of.
