This petition is moved challenging an order passed by the learned Trial Judge thereby rejecting applications filed by the prosecution for issuing bailable warrant to the prosecution witnesses to examine in sessions trial bearing Sessions Case No. 241/2015 pending before the Sessions Court, Ahmednagar. The petitioner is original informant. The respondents are facing trial for the offences punishable under Sections 307, 323, 504, 506,109, 143, 147, 148, 149 of the Indian Penal Code and Sections 4/25, 3/25 of the Arms Act.

The accused have no objection to allow the writ petition and to examine the witnesses stated in applications below Exh. 257, 258 and 259. Only prayer of the accused is to direct the Court to expedite the hearing of the sessions case.

Considering the above, this Court is inclined to allow the petition. Criminal writ petition is, therefore, allowed in terms of prayer clause (B).

The learned Trial Court is requested to dispose of the trial as early as possible and preferably within three months from today. The prosecution to make every attempt and endeavour to serve the witnesses and to keep them present before the Court. 5.
