PER COURT :- The application is fled for relief of restoration of Criminal Writ Petition No. 788 of 2016 which was fled for relief of quashing of private complaint bearing Criminal Misc. Application No. 219 of 2016 and also the order of investigation passed by the learned Judicial Magistrate, First Class, Aurangabad under Section 156(3) of the Code of Criminal Procedure in it.

Today, learned A.P.P. produced on record communication made by Police Station Ofcer of Kranti Chowk Police Station, Aurangabad. This communication dated 21.12.2020, shows that in that matter 'C' summery report is fled by police which was approved by the higher ofcer on 11.11.2020. The report

It is up to the Court of learned Judicial Magistrate, First Class, Aurangabad now to decide as to whether report needs to be accepted or not accepted.
