Heard learned Counsel for the parties, perused pleadings in the petition, grounds taken therein and the relevant documents placed on record including reply filed by the respondents. We have considered the submissions of the learned Counsel for the parties and in particular Para 1.1.4.2 of the MH CET 2015: Preference Booklet i.e.

Distribution of seats in Regional 70% Quota, which reads, thus:

"1.1.4.2 Distribution of seats in Regional 70% Quota.

After exclusion of State 30% quota seats mentioned at Para 1.1.4.1 the remaining 70% seats from the colleges situated in the respective Developmental Boards will be filled from amongst the Candidates who have passed HSC (or

8490.15wp equivalent examination) from the Schools/Colleges situated in the region of the concerned Development Boards i.e. Rest of Maharashtra, Vidarbha and Marathwada. There will be constitutional, specified (except MKB quota seats) and female reservations for these seats as per rules."

Since the respondent No.5 has passed HSC from the school / college situated in Marathwada region, in our opinion, case of the respondent No.5 is squarely covered under the aforesaid provision. Apart from the above, the petitioner has already been admitted in the Medical College at Ambejogai and the respondent No.5 has been admitted at Medical College, Latur and they are prosecuting their studies in respective colleges. In that view of the matter, we are not inclined to entertain this petition. Hence, petition stands rejected. (P.R. BORA, J) (S.S. SHINDE, J) kadam/
