2] It is an admitted fact that the time taken in prosecuting the revision petition filed by the applicant before the Sessions Court, which was not maintainable, will have to be ignored. Learned counsel for the respondent, however, submits that there was delay in filing the revision petition.

Learned counsel for the applicant submits that the delay in filing revision petition was condoned by the Sessions Court.

4] The delay is, therefore, condoned.

Present application is allowed and disposed of accordingly.
