The applicant seeks to condone the delay of 11 days caused in filing the second appeal.

Although, respondents are served with notice of this application, none appears. Applicant states that delay is occasioned due to communication gap between himself and his advocate and also for collecting the documents, which is not intentional. 4.

Looking to the fact that applicant is litigating for rights over immovable property, the case is made out to condone the delay. Hence, application is allowed. Delay of 11 days caused in filing the appeal is condoned. CA stands disposed of.
