The learned counsel appearing for the petitioner submits that excess amount of Rs. 2,11,604/- which is directed to be paid is not withdrawn by the claimant/petitioner and is available before the Executing Court. 2.

Having considered the submissions of the parties and perusing the record, it is seen that the excess amount is deposited by the Acquiring Body before the Executing Court, and the Executing Court has directed to refund the excess amount to the acquiring body. In view of the same, nothing remains to be adjudicated in the present matter. No case is made out by the petitioner. Accordingly, writ petition is dismissed. ( ARUN R. PEDNEKER, J. ) ssc/
