Petitioner seeks relief of taking action for contempt of the order of this Court passed on 25.01.2024 in Writ Petition No.958 of 2024, whereby respondent No.3 - Director of Medical Education in main writ petition was directed to consider representation dated 14.07.2020 as per rules, which was filed by petitioner.

Today, learned AGP is placing communication of Under Secretary, Government of Maharashtra stating that respondent No.3 had no jurisdiction to decide the said representation and, therefore, had forwarded

909_CP_764_2024 said representation to State Government who has power to decide and the State Government will take the decision within a period of four weeks. In fact, respondent No.3 could have given reply in respect of said representation immediately after the representation was filed on 14.07.2020, but it appears that no such step was taken.

Now, the State Government is giving written communication that it will decide the said representation within a period of four weeks. This written communication dated 12.09.2024 is taken as undertaking. We hope and trust that it will be decided as per the undertaking. In view of this position, we dispose of the petition with liberty to the petitioner to approach this Court, if there is no compliance of the written communication. (S.G. CHAPALGAONKAR, J.) ( SMT.
