1] The petitioner challenges the order dated 30.06.2025 passed by the respondent no.1-Commissioner of State Excise, Mumbai in Appeal, remanding the matter back to the Collector, Beed to decide the transfer application of the petitioner, expeditiously. 2] The learned counsel for the petitioner submits that the application of the petitioner for shifting FL-III license from property No.668, Survey No.123/2, Umari, Taluka Keij, District Beed to the Property No.681, Survey No.82/2/1, Mauje Massajog, Taluka Keij, District Beed was dismissed by the Collector. He further submits that

10838.25WP thereafter the petitioner preferred an Appeal before the respondent no.1-Commissioner. He further submits that after considering the submissions of the petitioner, the Commissioner, by order dated 30.06.2025, has remanded the matter back to the Collector after setting side the order of the Collector.

3] I do not see any error in the order passed by the respondent no.1-Commissioner, remanding the matter back to the Collector. The petitioner has not able to demonstrate any error in the order passed by the respondent no.1 Commissioner. Finally, the learned counsel for the petitioner submits that the concerned Authority i.e. Collector be directed to dispose of the application of the petitioner within reasonable time. The Collector before whom the application of the petitioner is pending, to decide the same as expeditiously as possible, preferably within a period of five months. The Writ Petition is disposed of accordingly.
