The learned counsel for the respondents have preliminary objection as regards maintainability of the instant petition under Article 226 of the Constitution of India.

Realizing the difficulty, the learned counsel appearing for the petitioner fairly submits that, this petition may be transferred to the Maharashtra Administrative Tribunal (MAT) and may be considered as Original Application.

In light of the submissions made across the bar, the Registry is directed to transfer this petition to the Registry of MAT. Upon receiving such writ petition, the Registry of MAT shall allow the petitioner to take procedural steps so as to convert the same into O.A. Upon such steps are taken, the Tribunal to take up the application for hearing. The parties to appear before the MAT on 25.07.2016.
