1] By order dated 31st July, 2023, this Court had recorded that the parties had settled the matter and that compromise pursis was filed in that regard. The parties were present before this Court. This Court directed the parties to remain present before the Registrar [Judicial] to verify the compromise. The Registrar [Judicial] was also asked to submit a report in that regard before this Court.

812.09SA 2] In view of the aforesaid order, after verification of the compromise the Registrar [Judicial] submitted it's report. On enquiry, the Registrar [Judicial] found that the parties have voluntarily entered into the compromise and no force or fraud is played upon them.

3] In terms of the compromise, the present Second Appeal is disposed of.

4] Decree be drawn in terms of the compromise.

5] In view of disposal of Second Appeal, Civil Application No.12007 of 2009 does not survive and the same stands disposed of.
