This is a pre arrest bail application, apprehending arrest in crime no. 0084 of 2025 registered at Maujpuri Police Station, District Jalna for offence under Sections 109, 189(2), 191(2), 191(3), 190, 115(2), 352, 351(2), 351(3) of BNS and Section 37(1) of the Maharashtra Police Act.

Learned counsel pointed out that, as many as 26 persons are named in the above FIR. That, on 11.04.2025, informant allegedly
-2learnt from his nephew Ravichandra about abuses being hurled by Sandip, Suresh, Ramesh, Sharad, Rajvir and it is alleged that when they were asked, informant was assaulted by means of stick, iron rod etc. Learned counsel pointed out that, as regards to present applicant Ramesh is concerned, allegation against him is of using iron rod but it was hit on hand and not a vital part. That, applicant is ready to cooperate with the investigating machinery. Custodial interrogation is not necessary. For all above reasons, he urges for grant of bail, by pointing out that co-accused namely Sharad, Suresh, Sandip, Ganesh and Manohar are already beneficiaries of bail at the hands of trial court and copies of the orders to that effect are annexed herewith. 3.
Learned APP opposed on the ground that, there is use of article like iron rod. That, applicant has eight crimes registered against him. Medical papers are placed on record and for effective investigation, he prays to reject the application.

Heard. Perused the papers and FIR dated 13.04.2025 at the instance of one Murlidhar Shejul and he has reported (i.e. while he was in ICU) that, on 11.04.2025, he received phone call from his nephew Ravichandra about abuses at the instance of Sandip and Suresh r/o Ramnagar and hence informant went there to question
-3them and give understanding. It is alleged that, at that time, above persons, along with others, including present applicant, all r/o Ramnagar, mounted assault on informant. As regards to present applicant Ramesh is concerned, allegations against him are that he was armed with iron rod and he hit it on the hand of informant. Due to assault by Suresh, he suffered head injury. Informant has alleged that his nephew was also assaulted.

Annexures placed on record go to show that learned trial court has already granted regular bail to Sharad, Suresh, Sandip, Ganesh and Manohar by two separate orders dated 17.05.2025. Copies of the same are placed on record. Moreover, it appears that there are cross complaints. Taking such above discussed material into consideration along with the site of injury, i.e. hand, and also taking into account the ground of parity, the applicant deserves relief as prayed. Hence, following order :
ORDER
I.
The application is allowed.
II.
In the event of arrest of the applicant in connection with 0084 of 2025 registered at Maujpuri Police Station, District Jalna for offence under Sections 109, 189(2), 191(2), 191(3), 190, 115(2),
-4352, 351(2), 351(3) of BNS and Section 37(1) of the Maharashtra Police Act, he shall be released on executing P.B. and S.B. of Rs.25,000/- with one surety in the like amount. III.
The applicant shall attend the concerned Police Station as and when called by the Investigating Officer till filing of the charge sheet and co-operate in the investigation.
