Heard Mr. A.S. Barlota, learned Advocate for the applicant and Mr. Solanke, learned Advocate, who has received instructions to appear on behalf of the respondent.

This is an application seeking condonation of delay of 81 days, that is caused in filing criminal revision application. Learned Advocate for the applicant submits that the delay is only of 81 days & is caused because of the reasons stated in para 4 of the application.

Learned Advocate for the respondent opposed the application

( 2 ) cria2787.22 stating that there is no sufficient reason given in the application. He states that he has also filed criminal revision application challenging the same judgment and order.

Considering that both the parties have filed criminal revision applications, arising out of same judgment and order, it is desirable to grant both parties an opportunity to contest the matter on merit. Hence, the delay deserves to be condoned.

05.

The Criminal Application is allowed. Delay of 81 days caused in preferring present Criminal Revision Application is condoned. Criminal Revision Application be registered.
