Heard Mr. Kadethankar, learned advocate for the applicants and Mr. S.S. Jadhavar, learned advocate for non applicant No. 3.

The applicants are asked to submit an undertaking for ad-hoc increment. According to the applicants, clause 6 of the said undertaking is against the interest of the applicants and against the reliefs claimed in the writ petition. In the writ petition, prayer is made for regularization in service and/or absorption. Under clause 6 of the undertaking, the applicants are required to state

CA No.9619/21 that the appointments of the applicants are made for a particular project and applicants will not have right to claim regularization on any basis.

The grievance of the petitioner for regularization in service is subjudiced before this Court. If the non applicants are asking the applicants to execute the undertaking, the same shall be without prejudice to the rights and contentions of the either party and will be subject to final decision of the writ petition. The applicants may execute the same under protest and subject to the decision in the writ petition.

Civil application is disposed of. No costs.
