2] The proceeding is filed under Section 482 of the Code of Criminal Procedure for relief of quashing of FIR No. 61/2018 registered with Ashti Police Station District Jalna for the offences punishable under
976- Cri. Appln No. 2180-2018.odt Sections 498-A, 323, 504, 506 read with Section 34 of the I.P.C. 3] The crime is registered on the basis of report given by respondent no.2. She was given in marriage to Vinod Chavan on 05.11.2017. This Court has perused all the allegations made in the FIR by the respondent. Not a single allegation is made in the FIR specifically as against the present applicant. In the FIR it is mentioned that he is brother of her husband but the name of the father of the applicant is different. It appears that he is distinctly related to the husband of the respondent no.2. It appears that he is practicing Advocate and due to some relationship with the husband family he is roped in. As there are no allegations at all against him. This Court holds that relief needs to granted him. In the result following order :--
ORDER
I] Application is allowed.
II] Relief is granted in terms of prayer clause (B). III] Rule made absolute in the aforesaid terms.
