Both these petitions are decided by this common order since the issue involved therein is one and the same.

Both the petitioners have been serving with respondent Zilla Parisahd since 1991 as Parichar. They were being paid a sum of Rs.140/- per month initially. The same was gradually increased to Rs. 3,500/- per month. Since 2019, they have been receiving the said amount per month. Both have been rendering services as full time Parichar.

Learned advocate for the respondent Zilla Parishad relies on the Apex Court judgment in the case of Dr. Chanchal Goyel vs State of Rajasthan in Civil Appeal No. 7744 of 1997. He referred to the said judgment as has been quoted in the Government Resolution dated 25.08.2005. The copy of the said judgment is not made available to us. We are, therefore unable to go through the said judgment to find the same in favour of the respondent Zilla Parishad. 5.

On the contrary, Division Bench of this Court vide order dated 11.04.2017 in Writ Petition No. 4109 of 2016, directed the concerned Zilla Parishad to pay the petitioners therein 50% of the salary admissible to the full time Parichar. There was further direction to pay the arrears in that terms within a period of six months. 6.

Since the petitioners are similarly placed, we have no hesitation to pass the order similar to that relied on by the petitioners. 7.

For the reasons stated herein-above, both the petitions stand allowed with direction to respondent Zilla Parishad to pay to the petitioners 50% of the salary admissible to the full time Parichar from three years next before the filing of the petitions to date and continue to pay the same so long as they render such service.
