Mr.Deshmukh, the learned counsel for the petitioner submits that under the impugned order the All India Council for Technical Education(AICTE) has reduced the intake capacity of the petitioner by 50% while granting approval for the year 2019-20 to B-Pharmacy and D-Pharmacy course.

2] The learned counsel submits that the petitioner has removed all the deficiencies. The order impugned is passed on the basis of the document submitted however, the AICTE/Standing Appellate Committee (SAC) did not have an opportunity of actual inspection. The learned counsel submits that petitioner is ready to deposit Rs.2 lakhs. The respondent be directed to conduct additional expert Visiting Committee Inspection. The same is permissible under Clause 1.4.2 (D) of the Approval Process Hand Book.

wp9321-19 3] Mr.Adwant, learned advocate for AICTE upon instructions submits that the petitioner shall deposit Rs.2 lakhs by tomorrow i.e. 3/8/2019. In case the petitioner deposits Rs.2 lakhs by 3/8/2019, then additional expert visit committee would conduct the inspection of the petitioner institution on 6/8/2019. A report would be submitted to the SAC and the petitioner may remain present before the SAC on 7/8/2019 and the AICTE shall take decision with regard to the intake capacity of the petitioner for B-Pharmacy and DPharmacy course on 8/8/2019. 4] The said statement is accepted. In view of the above, Writ Petition is disposed of. No costs.
