We have heard Mr. Ghatol Patil, the learned counsel for the petitioner, the learned A. G. P. and the learned counsel for the respondents.

It is admitted that the petitioner did not secure D.Ed. qualification in the year 1998. As per the conditional approval granted, the petitioner has secured B. Ed. qualification in the year 2000 and thereby the petitioner is granted approval.

It appears that the petitioner was working with the respondent No. 5. The case of the petitioner for grant of approval at present cannot be considered, however, the period from 23.9.1998 to 9.2.2000 shall be considered for the purpose of continuity of service and other benefits.

With this observation, the writ petition is disposed of. No costs. The petitioner will not be entitled to claim the salary for the said period from the same.
