The petitioner who has been elected as a Sarpanch is mandated by law to produce a scheduled tribe certificate within a stipulated time. The learned advocate for the petitioner submits that the time is to expire by 17.01.2023. He submits that his matter is already under consideration before the Scrutiny Committee Nandurbar but it is not being decided finally. 3.
The learned A.G.P., on instructions, submits that the case of the petitioner is currently awaiting a vigilance report and it would take another six months to decide his proceeding.

In view of the mandate of law, we cannot prevent the consequences that would ensue pursuant to inability of the petitioner to produce the scheduled tribe certificate within a stipulated time. 5.
We dispose of the writ petition by requesting the Scrutiny Committee to endeavour to decide the petitioner's case, as early as possible by 17.01.2023.
