Heard the parties. The dispute is only as regards the valuation of the trees. The existence of the trees is not disputed. The learned Advocate submits that out of the amount granted towards compensation is only Rs. 3,78,000/- and some odd amount is towards compensation of trees, where as the valuation is granted is Rs.12,84,247/-. Considering the above position following order :

ORDER

(i) The applicants are permitted to withdraw amount deposited in this Court except amount to Rs. 3,78,711/- alongwith interest accrued and for that purpose this Court shall transmit remaining amount with accrued interest to the learned Reference Court, Sangamner.

(ii) With this the Civil Application stands disposed off. DELAY 1.

This application is filed for condonation of delay of 26 days caused in filing Cross Objection.

For the reasons stated in the application, the application stands allowed.

The Civil Application stands allowed and disposed off.

The office to register the Cross Objection.
