IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD.

APPELLATE SIDE JURISDICTION MISC.CIVIL APPLICATION NO. 105 OF 2014 PRIYANKA VINOD SHINDE

VERSUS

VINOD UTTAM SHINDE ...

Advocate for Applicant : Mr. Shivprasad G. Jadhavar. Advocate for Respondent : Mr. Undre, Advocate i/b Mr. Ajay T. Kanawade. ...

CORAM :

N. W. SAMBRE, J.

DATE :

11th August, 2015.

Per Court:

.

Mr.Undre, learned counsel instructed by Mr.Kanawade, learned counsel for the Respondent has strenuously opposed the prayer on the ground that the proceedings are initiated based on territorial jurisdiction pursuant to the pleadings in the application. The application for transfer, in my opinion, needs to be granted as the Applicant - wife has established the hardship as she is having a daughter of nine months old and will be required to attend the proceedings alongwith said daughter.

In view thereof, the present miscellaneous civil application stands allowed in terms of prayer clause (B). [ N. W. SAMBRE, J. ] ndm
