Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.207 of 2023 registered with Kotwali Police Station, Ahmednagar, for the offences punishable under Sections 417, 419, 420, 465, 468, 471 and 406 read with Section 34 of the Indian Penal Code. 3.

It is a case of playing fraud. Under a promise to give them the jobs, the boys were cheated. It has been alleged against the present applicant that he promised to give them job orders, but did not. Except this, there were no allegations against the applicant. The amount of Rs. around 56 Lakh has been recovered from the main accused No.1. Since the day of his arrest, nothing

930-BA-1288-23.odt has been recovered from the applicant. There are no allegations against the applicant that the money received for providing a job was paid directly to him. Considering the role attributed to him and progress in investigation about him, the Court is of the view that his detention would not serve the purpose. Hence, the order:- i) The application is allowed.

ii) Applicant Javed Abbas Patel be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.207 of 2023 registered with Kotwali Police Station, Ahmednagar, for the offences punishable under Sections 417, 419, 420, 465, 468, 471 and 406 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall attend the police station as and when called by the Investigating Officer on a written notice, till filing the chargesheet.
