There is counter appeal filed by the Municipal Corporation in which there is delay of 232 days. The Corporation cannot cause huge delay on the ground of time default of procedural formalities. Since the appeal of the claimant has been admitted by condonation of delay, the delay in the present matter is condoned in the interest of justice subject to the costs of Rs. 5,000/-.
