Heard learned advocates appearing for the respective parties.

The appellant/insurance company contested the claim on the ground that claimant/injured was travelling in the goods carriage vehicle.

Apparently, FIR and other documents shows that marriage party was being carried in the vehicle at the time of accident and claimant was one of member of the marriage party. However, Tribunal passed award directing respondent nos.1 and 2 to jointly and severally pay the compensation.

Learned advocate appearing for the applicant submits that applicant is ready to furnish solvent security, in case withdrawal is permitted.

Considering the submissions advanced, applicant can be permitted to withdraw 50% of the amount alongwith accrued interest as deposited by the insurance company subject to furnishing of solvent surety/security of the like amount in addition to personal undertaking that she will re-deposit the amount in case, she is directed by this Court at the conclusion of the appeal. CA stands disposed of.
