By way of present application, the applicant is seeking to condone the delay of 321 days in filing the First Appeal. He further submits that the applicant is willing to waive statutory interest for the delayed period. 02.

The learned Advocate for respondent No.2 has opposed the application on the ground that the delay has not been properly justified. 03.

No one has attributed mala fides to the applicants on the point of delayed application. In the circumstances, since the delay is trivial, it stands condoned. The application is allowed.
