Having heard learned Counsel for the applicant, the order dated 07/08/2015 passed by learned Judicial Magistrate, First Class, Shevgaon below Exhibit-1 in Cri. M.A. No. 257 of 2015, particularly condition No. 4 is modified as under. 2.

In view of undertaking furnished by the applicant that he shall furnish bank guarantee of Rs.1,00,000/- as directed by learned Judicial Magistrate, First Class, Shevgaon within period of six weeks from today, the vehicle of the applicant bearing registration No. MH16-AY-2744 as ordered to be released is permitted. The undertaking is taken on record.

It is made clear that in case if the undertaking is not complied with, the investigating agency will be at liberty to move before this Court for recalling of this order and also for cancellation of the bail of the accused.
