DATE : SEPTEMBER 07, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0293 of 2022 registered with Shivaji Nagar Police Station, Dist.Latur.

Heard learned counsel appearing for the parties. 3.

The amount involved in the present crime is Rs.12,80,000/- approximately. Learned counsel for the applicant states that the applicant is ready to deposit that much amount under protest.

The applicant is behind the bars for about two months. He is a retired employee of Labour Department. The offence dates back

6-BA.1345.2022 to year 2015. Since the applicant is ready to deposit Rs.12,80,000/-, the Court is inclined to grant him bail on certain conditions. 5.

Hence, the following order:- (i) The application is allowed.

(ii) On condition that the applicant shall deposit Rs.12,80,000/- (Rupees Twelve Lakhs Eighty Thousand) with the trial court, the applicant be released in connection with Crime No.0293 of 2022 registered with Shivaji Nagar Police Station, Dist.Latur, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) It is made clear that depositing the amount by the applicant, as directed above, shall be a condition precedent for grant of bail.

(iv) The applicant shall not tamper with the prosecution evidence in any manner.
