The petitioner is challenging the order dated 10.03.2017 passed by learned Additional Sessions Judge, Jalna, in Criminal Revision No.129/2011 by which, the said revision filed by the respondent came to be allowed and the order dated 07.07.2011 passed by learned JMFC in Criminal M.A. No.59/2010 is set aside and said Criminal M.A. No.59/2010 is rejected.

The petitioner has filed the proceedings under Section 125 of the Code of Criminal Procedure, which are registered as Criminal M.A. No.59/2010. Learned JMFC vide order dated 07.07.2011 has granted maintenance of Rs.500/- per month to the petitioner. However, the revision filed by the respondent came to be allowed by the impugned order. Hence,

Learned advocate for the petitioner submits that the petitioner is not responding for giving instructions. The respondent, who was husband of the petitioner, is now reported to be dead.

This petition is pending since 2019. There is no stay granted by this Court. The petition was never circulated and listed for hearing. On the last occasion, the matter was adjourned by way of last chance. The sole respondent, who was husband of the petitioner, has expired. The petitioner, who is about 75 years of age, is also not responding to learned advocate. It, therefore, seems that the petitioner is not at all vigilant and alert in the proceedings. As such, this Court cannot come to her aid, who is sleeping over her rights. In that view of the matter, I am not inclined to entertain this petition.

In view of the above, nothing survives in this petition. This Criminal Writ Petition is, therefore, dismissed. kps ( SUSHIL M. GHODESWAR, J. )
