Learned Counsel appearing on behalf of the applicants does not press the present application to the extent of applicant no.3 Navnath s/o Ganpat Datir, as he has surrendered. Thus, the present application to the extent of applicant no.3 Navnath s/o Ganpat Datir, stands dismissed as not pressed.

Perused the investigation papers and the medical certificate. The main allegations are against applicant no.3 - accused Navnath s/o Ganpat Datir, who has already surrendered.

Looking to the investigation papers and the nature of allegations, coupled with the fact that the offence is punishable under section 326 of the Indian Penal Code, in my opinion, it will be appropriate to grant protection to the applicants. I, therefore, pass following order :- In the event of arrest of applicants, namely, (1) Sakharam s/o Ganpat Datir, (2) Jitendra s/o Sakharam Datir, (4) Ananda s/o Ganpat

criap4358.15 (2) Datir, (5) Eknath s/o Ganpat Datir and (6) Pandurang s/o Ganpat Datir, in connection with C.R. No.I-40 of 2015, registered with Ashvi police station, Tq. Sangamner, Dist. Ahmednagar, for offences punishable under sections 326, 324, 143, 147, 504, 506 of the Indian Penal Code and under sections 37 (1) (3) and 135 of the Bombay Police Act, they be released on bail, on each of them furnishing P.R. Bond of Rs.10,000/- with one surety in the like amount.

The applicants shall attend the concerned police station daily, between 10.00 a.m. and 11.00 a.m., initially for three days and thereafter as and when called by the Investigating Officer. The applicants shall keep themselves away from the jurisdiction of the concerned police station till filing of the charge-sheet, save and except for attending the police station.
