At the outset, learned Counsel for the Applicant seeks leave to amend prayer clause to permit him to withdraw amount from Investigating Officer. 2.

Leave granted. Amendment to be carried out forthwith.

Learned Counsel for the Applicant states that an amount of Rs. 5 lacs was deposited by the Respondent No. 2 - Sanjay pursuant to the order dated 02.03.2017 passed in Criminal Application No. 973/2017 by this Court.

Learned Counsel for both sides apprised the

13-APPLN-2700-2023.odt Court that though initial direction was to deposit amount with this Court, however, subsequently the amount came to be transferred to the investigating officer.

In view of this, appropriate direction needs to be issued to the investigating officer for permitting the Applicant herein to withdraw the said amount.

In view of above, application stands allowed in terms of prayer clause 'B'.
