After filing of the pursis for withdrawal of the appeal, this has been brought to the notice of this Court that Civil Application No. 9180 of 2014 filed for bringing the legal representatives of the deceased appellant on record alongwith the prayer for condonation of delay is still pending. The learned counsel for the deceased appellant submits that the appeal has been withdrawn under the instructions of the legal representatives of the deceased. In view of the same, learned counsel appearing for the other side has also no objection if this civil application is allowed in terms of its prayer clause.

In view of the above and for reasons stated in the civil application, Civil Application is allowed in terms of the prayer clause B & C.
