IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 9363 OF 2018 Amol s/o Jagdish Jagrut Petitioner

Versus

The State of Maharashtra & others Respondents Ms. P.J. Bharad, advocate for petitioner.

Mrs. V.N. Patil Jadhav, AGP for respondents 1 to 6. Mr. R.S. Dhamangaonkar and Mr. GM. Jakkadwar, advocates for respondent no. 7.

CORAM : R.M.BORDE AND MANGESH S. PATIL, JJ.

DATE : 16th October, 2018.

PER COURT :

1.

Petitioner is objecting to the work order issued in favour of respondent no. 7 on 19.07.2018. Estimated cost of the work is Rs.16,03,419/- and the offer made by respondent no. 7 is 27.27% below the estimated cost. Petitioner claims that some part of the work has been carried out by him without there being any written instructions in that behalf from the department. 2.

It would be difficult to take cognizance of such a statement in the absence of any material to substantiate the contention. If at all, petitioner is of the opinion that he has done certain work for which he is required to be paid by the department, it would be open for the petitioner to take appropriate proceeding for redressal of his grievance.
