PER COURT :- The learned counsel appearing for Respondent No.3 - Corporation raised a preliminary objection about the maintainability of this Petition on the ground that, the petitioners have never approached the Municipal Corporation, Ahmednagar for redressal of their grievances by filing the representation/application.

In the light of the preliminary point raised by the learned counsel appearing for Respondent No.3, the learned counsel appearing for the petitioners without advancing arguments on merits, seeks permission to withdraw the Petition with liberty to file representation/application for redressal of their grievance raised in the Petition.

The Petition is dismissed as withdrawn with liberty as prayed for.

In case, representation is filed within four weeks from today, the Respondent No.3 - Commissioner, Municipal Corporation, Ahmednagar shall decide the said representation/application, after hearing the petitioners, as expeditiously as possible, preferably within 10 weeks from filing of such application/representation.
