Heard the learned counsel for the applicant.

The applicant - wife is seeking transfer of HMP No.134 of 2022, pending before Jt. CJSD, Jalgaon to Family Court Dhule. According to the applicant she is not having any independent source of income and she has to maintain a minor daughter born out of this wedlock. She is having old age parents, who are unable to accompany her for attending the dates at Jalgaon. Moreover, there will be nobody to look after her minor daughter in case if she has to attend the dates at Jalgaon.

The respondent despite service did not care to appear before this court and by fling HMP No. 134 of 2022 he is seeking divorce from the applicant wife. Therefore, considering all these aspects and specially the conduct of respondent husband following order is passed.

ORDER

I) The application is hereby allowed.

2 986 mca 219-22 II) The HMP No. 134 of 2022, pending before Jt.

CJSD, Jalgaon is hereby transferred to Family Court Dhule for disposal according to law.

III) The respondent is directed to appear before the Family Court, Dhule on or before 19/12/2022.

IV) The application is accordingly disposed of.
