The petitioner claims to be a registered public trust doing social service. It applied to respondent/MIDC for grant of plot in a green zone, for plantation of trees. In response to petitioner's application, the MIDC even directed the surveyor to survey the land. In the meanwhile, corona pandemic erupted. The petitioner after some days learnt the plot to have been converted into industrial zone and has even been allotted to respondent no.4. The respondent no.4 has commenced an industry on the very plot by spending a huge amount. As such, the matter reached at a irreversible stage. 3.

There is nothing to indicate the respondent/MIDC to have extended the petitioner even a promise of granting the said plot

945-wp-9205-2022.odt (2) or any other plot in the green zone for the purpose of plantation. The petitioner/trust does not have a vested right to claim a particular plot for its particular purpose. In our view, writ petition is devoid of merit. If the petitioner prefers similar application to respondent/MIDC, the same may be considered on its own merit.

With these observations, we dispose of the writ petition since it sans merit.
