Heard the learned Advocates appearing for the parties on merits. The learned Advocate for the applicant states that the applicant has already surrendered to the custody and presently he is in the custody. He produced on record copy of application preferred by the applicant surrendering himself before the Trial Court on 06.09.2022. Same is taken on record. 02.

In view of the order passed in the revision application issuing notice to the State and considering the length of sentence, it is desirable that the sentence awarded by the Judicial Magistrate, First Class, Jalgaon vide order dated 08.02.2016 in SCC No.25 of 2010, confirmed by the Adhoc

( 2 ) cria2859.22 Additional Sessions Judge, Jalgaon vide order dated 11.08.2022 in Criminal Appeal No.29 of 2016 is required to be suspended. Hence, the following order is passed :-

O R D E R

1) The Criminal Application is allowed.

2) The order of sentence awarded by the Judicial Magistrate, First Class, Jalgaon vide order dated 08.02.2016 in SCC No.25 of 2010, confirmed by the Adhoc Additional Sessions Judge, Jalgaon vide order dated 11.08.2022 in Criminal Appeal No.29 of 2016 is hereby suspended.

3) The applicant shall be released on bail on his executing PR bond of Rs.15,000/- (Rupees Fifteen Thousand) with out solvent surety in the like amount.
