Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0229/2022, registered at Gondi Police Station, District Jalna for the offences punishable under Sections 363, 395, 409, 412, 420 read with Section 34 of the Indian Penal Code. 2.

It is a case of road robbery. The stolen goods are in the nature of 30 tons of iron bars. 14 tons of steel has been recovered. 12 tons from the present applicant. The applicant on his own expressed his willingness to deposit a sum of Rs.2,00,000/-. Co-accused has already been granted

bail. The applicant has not been identified in test identification parade. He is in jail for about 2 1⁄2 months. The Court is, therefore, inclined to grant him bail. Hence the order :-

O R D E R

(i) The Bail Application is allowed.

(ii) On condition of the applicant depositing a sum of Rs.2,00,000/- (Rupees two lakhs) with the trial Court within a period of four weeks from today, the applicant be released on bail in connection with Crime No.0229/2022, registered at Gondi Police Station, District Jalna for the offences punishable under Sections 363, 395, 409, 412, 420 read with Section 34 of the Indian Penal Code on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. On deposit of the amount, the same shall be treated as muddemal.

(iii) The applicant shall not tamper with the prosecution evidence.
