Shaikh Shafiq Shaikh Umer v. The State Of Maharashtra And Others
1 wp 9765.16
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 9765 OF 2016 Shaikh Shafiq Shaikh Umer .. Petitioner
Versus
The State of Maharashtra and others .. Respondents Shri H. V. Tungar, Advocate for the Petitioner. Shri S. G. Karlekar, A.G.P. for the Respondent No. 1. CORAM : S. V. GANGAPURWALA AND A. M. DHAVALE, JJ.
DATE : 07TH FEBRUARY, 2018.
FINAL ORDER :
.
The petitioner seeks to challenge the validity certificate issued in favour of the respondent No. 3.
2.
Mr. Tungar, the learned counsel for the petitioner states that, the respondent No. 3 is brother-in-law of the petitioner. The respondent No. 3 has obtained validity certificate fraudulently. According to the learned counsel, question of locus would not arise in such matters. The learned counsel relies on the judgment of the Apex Court in a case of Raju Ramsingh Vasave Vs. Mahesh Deorao Bhivapurkar reported in AIR (SC) 2008 514.
2 wp 9765.16 3.
It appears to be a personal domestic grudge between the parties. The respondent No. 3 is brother in law of the petitioner. After the relations became strained, the petitioner has approached this Court seeking to challenge validity issued in favour of the respondent No. 3 in the year 2006. We would not encourage personal disputes to be brought before this Court in such matters.
4.
Considering the above, we are not inclined to entertain the writ petition and reopen the matter of validity certificate issued in the year 2006 by entertaining this petition now. The writ petition is disposed of. No costs.
